Terms of Use – Transforormation360 Welcome to Transformationn360, our online ideation and process platform. What we offer – called our “Service” in this document – includes (without limitation) all websites, mobile applications and other interactive programs we deliver through. The Transformation360 Service is owned, operated and distributed by Innovation 360 Group AB (referred to here as “Transformation360” or “we” and by “us,” “our,” etc.).

If you access any part of the Service, you are automatically agreeing to the terms and conditions described below (“these Terms of Service”), the terms and conditions of our privacy policy (the “Privacy Policy”) and any other legal notices published by us on the Service (collectively, the “Governing Documents”). We refer to you as a “User” in these Terms of Service.

If you do not agree to any of these terms, you should not use the Service.

These Terms of Service apply to all Users of the Service – you must abide by them even if you are just browsing the available content and are not yet a registered member of Transformation360.

We may, at our sole discretion, modify these Terms of Service at any time. If you access the Service at any time after such modifications, you are automatically agreeing to such modifications. These Terms of Service were last modified on June 29, 2024.

GENERAL

You are required to comply with all applicable laws in connection with your use of the Service and the Website and you guarantee that you will not use the Service or the Webiste for any unlawful purpose or in a way which is prohibited in these Terms of Use.

We may restrict, suspend or terminate your access to the Service without notice if we believe that you have violated the provisions in these Terms of Use.

USER CONTENT

You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links (“Content”) that you submit, post, and display through the Service.

You represent and warrant that the posting and use of your Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person.

We prohibit behavior, including but not limited to, that harasses, intimidates, or uses fear to threaten or abuse another person.

As example you may not use the Services or our Website to:

promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease;
promote child exploitation;
post nude, partially nude, or sexually suggestive photos;
abuse, harass, threaten, impersonate or intimidate other Transforormation360 users; or
post hateful imagery and comments

We may, but have no obligation to, remove Content and accounts containing Content that are in violation with the provisions in these Terms of Use.

While Transforormation360 prohibits such conduct and Content, you understand and agree that Transforormation360 cannot be responsible for the Content posted through the Service and that you, nonetheless, may be exposed to such material and content and that you use the Transforormation360 Service at your own risk

Transforormation360 does NOT claim ANY ownership rights to the Content.

YOUR ACCOUNT

You are responsible for any activity that occurs through your account. You are responsible for keeping your password secure and to not let any third person access or use your account.

You acknowledge, consent and agree that we may access, preserve and disclose your account information and Content if required to do so by law or if we in good faith belief that such access, preservation, or disclosure is reasonably necessary to:

(a) comply with legal process;

(b) enforce these Terms of Use;

(d) respond to for customer service.

We reserve the right to reclaim user names on behalf of businesses or individuals that hold legal claim or trademark on those usernames.

PROPRIETY RIGHTS

You acknowledge that Transforormation360, or its affiliates, owns all intellectual property rights to the Service and in connection with Website and platform.

You acknowledge that you are strictly prohibited to:

modify, adapt or hack the Services or Transforormation360’s website or modify another website so as to falsely imply that it is associated with ours
access ours API (or iFramecode) by any other means other than our application itself
crawl, scrape, or otherwise cache any content from us including but not limited to user profiles and photos
transmit any worms or viruses or any code of a destructive nature into the Service or Transforormation360’s website.
violate any laws in your jurisdiction (including but not limited to copyright laws)
copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works of, transmit, sell or offer for resale, or in any way exploit any part of the Services or ideatoin360’s website without our express written permission
“mirror” any material contained through the Service or on Transforormation360’s website on any other server without prior written permission from us

Violation of any of these conditions will result, in our sole discretion, in the termination of your Transforormation360 account.

PRIVACY AND PERSONAL INFORMATION

Our Privacy Policy explains what personal information we collect and how we use it. You can access it on www.my360.global. If we, according to applicable law, need your explicit consent in order to process any of the personal information which we collect from you, we will let you actively give such consent to us prior to us processing your personal information.

LIMITED WARRANTY

Our Services and our Website, and links from our Website to any third-party websites, are provided AS IS, and we make NO REPRESENTATION OR WARRANTY OF ANY KIND with respect to the Services or our Website.

LIMITATION OF LIABILITY

Your sole and exclusive remedy for any cause of action arising under these Terms of Use is your right to terminate your use of the Services and our Website. You agree that we will not, to the maximum extent permitted by the law, be liable under any circumstances for any direct, indirect, consequential, special, exemplary, punitive or other damages, including lost profits or costs or attorney’s fees, arising out of or relating to your use of the sites, including but not limited to breach of contract, breach of warranty, negligence, or strict liability. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, our liability in such jurisdictions shall be limited to the extent permitted by law, but the provisions of this section shall in any case be interpreted to limit our liability to the greatest extent permitted by law.

INDEMNIFICATION

You agree to indemnify Transforormation360, and our officers, directors, owners, employees, agents, information providers, affiliates, partners, and licensors against, and hold them harmless from, claims, liability, losses, costs, and expenses (including reasonable attorneys’ fees) incurred as a result of or in connection with your use of the Services and our Website.

MODIFICATION OF THE SERVICES AND OUR WEBSITE

We reserve the right to, at any time, modify or discontinue, temporarily or permanently, the Services, or to terminate the Service for any reason, without notice at anytime.

You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services or Transforormation360 website.

TERMINATION

We reserve the right, in our sole discretion, to terminate, suspend, or limit your access to the Services or Website, or any portion thereof, at any time without notice to you. If we do so, the provisions of these Terms of Use will survive such termination

GOVERNING LAW AND INTEGRATION

Any dispute between you and Transforormation360 will be governed by the law of Sweden without regard to conflict of law provisions.
